Interim Measures for the Administration of Financial Subsidy Funds for Efficient Lighting Products Promotion Chapter 1 General Provisions

Article 1 According to the "Decision of the State Council on Strengthening Energy Conservation Work" (Guo Fa [2006] No. 28) and the "Notice of the State Council on Printing and Distributing the Comprehensive Work Plan for Energy Conservation and Emission Reduction" (Guo Fa [2007] No. 15) Funding to support the promotion and use of efficient lighting products. In order to strengthen the management of financial subsidies (hereinafter referred to as financial subsidy funds) for efficient lighting products and improve the efficiency of fund use, these measures are formulated.

The second financial subsidy fund is used to support the use of high-efficiency lighting products to replace incandescent lamps and other inefficient lighting products in use, mainly including subsidies for high-efficiency lighting products and promotion work.

Article 3 The subsidy funds shall be indirectly subsidized by the financial subsidies to the winning bidders, and then the winning bidders shall sell the products to the end users at the price after the bidding agreement minus the financial subsidy funds. The ultimate beneficiaries are bulk users and urban and rural residents.

Article 4 The financial subsidy funds shall be arranged by the central budget, and open and transparent management measures shall be adopted to accept social supervision.

Chapter II Subsidized Products and Beneficiaries

Article 5 The high-efficiency lighting products of financial subsidies are mainly self-ballasted fluorescent lamps for general lighting, three-color double-ended straight tube fluorescent lamps (T8, T5 type), metal halide lamps, high-pressure sodium lamps and other electric light source products, and semiconductor (LED) lighting. Products, as well as the necessary matching ballasts.

Article 6 The benefits of financial subsidies include large users and urban and rural residents. Large-scale users refer to industrial and mining enterprises, office buildings, hospitals, schools, hotels, commercial buildings, stations, machine-trailers, roads and other places where lighting products are concentrated. Energy-saving service companies that use contract energy management to promote efficient lighting products can be regarded as large-scale users; Resident users refer to users who purchase units in the community or administrative village.

Chapter III Successful bidders and product requirements

Article 7 The supply price of efficient lighting product promotion enterprises and agreements is generated through bidding. The state implements unified bidding, and according to the results of the bidding, publicizes the bidding enterprise, high-efficiency lighting products and the price of the bid-winning agreement.

Article 8 The high-efficiency lighting products provided by the winning bidders must meet the energy-saving evaluation values ​​of the national energy efficiency standards for lighting products. The specifications and models must pass the national energy-saving product certification.

Article 9 The winning bidder shall have a perfect after-sales service system and fulfill the agreed quality commitments (the bulk users shall not be less than one year, and the urban and rural residents shall be no less than two years).

Article 10 The winning bidder shall print the words “Government Subsidy, Green Photo Project” on the outer packaging and the body of the product.

Article 11 The winning bidder must sell the winning bidding product at the price after the bidding agreement minus the financial subsidy fund.

Chapter IV Subsidy Standards

Article 12 For each high-efficiency lighting product of large-scale users, the central government shall subsidize 30% of the supply price of the winning bid agreement; for each efficient lighting product of urban and rural residents, the central government shall subsidize 50% of the supply price of the winning bid agreement.

Chapter V Funds Declaration and Disbursement

Article 13 The National Development and Reform Commission and the Ministry of Finance shall jointly issue the annual efficient lighting product promotion tasks according to the annual promotion tasks of the national high-efficiency lighting products, population distribution, urban and rural development level and the use of incandescent lamps, and provide a list of successful bidders and products. Article 14 The provincial-level energy-saving competent department, in conjunction with the financial department, shall formulate specific implementation plans based on the actual promotion of high-efficiency lighting products issued by the National Development and Reform Commission and the Ministry of Finance, and clarify the name, model, quantity, and Manufacturers and promotion areas, etc., jointly reported to the National Development and Reform Commission, the Ministry of Finance for the record, and organized and coordinated the bid-winning enterprises to implement the promotion tasks.

Article 15 The winning bidder shall submit a financial subsidy fund application report (see Attachment 1) according to the high-efficiency lighting product promotion plan, the actual installation quantity of the high-efficiency lighting products, the bidding agreement supply price, and the subsidy standard. After reviewing with the competent department of energy conservation, report it to the provincial financial department and the energy conservation department.

Article 16 The provincial finance department shall, together with the competent department of energy conservation, review the enterprise fund application report, and report it to the Ministry of Finance and the National Development and Reform Commission before April 30 and August 31 of each year (see Attachment 2).

Article 17 The Ministry of Finance, together with the National Development and Reform Commission, conducts spot checks on the promotion of high-efficiency lighting products and the actual number of installations.

Article 18 The Ministry of Finance shall, according to the spot check, budget the financial subsidy funds and send a copy to the National Development and Reform Commission.

Article 19 The Ministry of Finance shall arrange certain promotion work funds according to the situation, and support the grassroots energy conservation departments, neighborhood committees or village committees to carry out relevant demand statistics, publicity materials, organization and liaison work.

Article 20 The financial departments at all levels shall, in accordance with the relevant regulations of the financial treasury management system, timely allocate the financial subsidy funds to the relevant units and the winning bidders.

Chapter VI Supervision and Management of Funds

Article 21 The enterprise is responsible for the authenticity of the application report for financial subsidy funds. For enterprises that falsify and defraud financial subsidies, the finance will recover the deductible subsidy funds, and the National Development and Reform Commission will cancel the supply qualifications of the enterprises and announce them to the public. Article 22 Financial subsidy funds must be earmarked for special purposes, and no unit may intercept or misappropriate for any reason or in any form. In case of violation of the provisions, in accordance with the "Regulations on Punishment of Financial Violations" (State Council Order No. 427) and other relevant provisions, the relevant units and personnel shall be investigated for responsibility.

Chapter VII Supplementary Provisions

Article 23 These Measures shall be interpreted by the Ministry of Finance in conjunction with the National Development and Reform Commission.

Article 24 These Measures shall be implemented as of the date of issuance.
